1. Scope

These Terms and Conditions apply to all purchases made via the online shop at www.marcowilmphotography.com by consumers, as defined under § 13 of the German Civil Code (BGB).

3. CONCLUSION OF CONTRACT

The presentation of products and workshops on this website does not constitute a legally binding offer. By clicking the “Place Order” button during checkout, you submit a binding offer to purchase. A contract is formed once you receive a confirmation email.

4. PRICES & SHIPPING COSTS

All prices listed include applicable VAT (if required by law). Shipping costs, if any, are displayed during the checkout process and added to the total price. For international orders, additional customs duties or taxes may apply, which are the responsibility of the customer.

5. PAYMENT

Payment must be made in full via the website at the time of booking or ordering. Available payment methods include PayPal and Stripe.
For workshops, your spot is only secured once full payment has been received. No payment = no reservation.

6. SHIPPING

Prints are shipped worldwide using trusted courier services (e.g., DHL). The estimated delivery time is typically 7–14 business days after payment is received. You will be notified once your order has shipped. For orders outside of the European Union, please get in touch to ask for shipping fee before placing the order. If the order arrives damaged, proof must be provided within 4 days, to get a replacement.

7. WORKSHOPS

The following terms apply to all workshops (1:1, 2:1, group, and online):
  • All workshops take place regardless of weather conditions. Please dress accordingly and come prepared.
  • Full payment is required at the time of booking to reserve your spot.
  • Cancellations can be made up to 30 days before the scheduled workshop date for a full refund, which will be processed within 14 days.
  • Cancellations made within 30 days of the workshop or no-shows are not eligible for a refund, without exception. However, you may transfer your spot to another person by notifying us in advance.
  • If Marco Wilm must cancel a workshop due to illness, unforeseen events, or force majeure (natural disasters, war, pandemics, government restrictions, etc.), you will be offered a full refund or the option to reschedule. Travel and accommodation costs will not be reimbursed.
  • Participants are responsible for their own health and safety. Marco Wilm is not liable for any injuries, accidents, or damages that may occur during the workshop.
  • Travel, accommodation, meals, and other expenses are not included in the workshop fee unless explicitly stated.
  • If you’re running late, please inform Marco immediately. For group workshops, we will wait up to 10 minutes. After that, the workshop will begin, and you can join later—Marco will share the live location to help you find the group.
  • In rare cases where a participant behaves inappropriately or poses a risk to the safety or well-being of others, Marco reserves the right to exclude them from the workshop without refund.

8. INTELLECTUAL PROPERTY & CONFIDENTIALITY

All material shared during the workshop – including images, editing techniques, slides, e-books, and handouts – is confidential and remains the intellectual property of Marco Wilm. You may not record, reproduce, publish, or distribute any content without written permission.

9. PHOTO & VIDEO USAGE

Marco Wilm may take behind-the-scenes photos or short video clips during workshops to be used for promotional purposes (website, social media, etc.). If you do not wish to appear in such content, please inform Marco before the start of the workshop, and your preference will be fully respected.

10. RETURNS & DAMAGED PRODUCTS

All fine art prints are made to order and produced individually with great care. For this reason, returns, cancellations, or exchanges are not accepted once an order is placed. However, if your print arrives damaged, please notify us within 5 days of delivery by sending an email to info@marcowilmphotography.com, including your order number, a description of the issue, and clear photos of the damage and packaging. In the case of verified damage during shipping, you will receive a replacement print at no additional cost. Please note: Slight color variations may occur due to screen differences and are not considered defects.

12. GOVERNING LAW & JURISDICTION

These Terms & Conditions are governed by the laws of the Federal Republic of Germany. If legally permissible, Berlin is agreed as the place of jurisdiction.

ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)

1. GELTUNGSBEREICH

Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen über den Onlineshop unter www.marcowilmphotography.com durch Verbraucher im Sinne des § 13 BGB.

3. VERTRAGSSCHLUSS

Die Darstellung von Produkten und Workshops im Onlineshop stellt kein rechtlich bindendes Angebot dar. Mit dem Klick auf den Button „Jetzt bestellen“ gibst du ein verbindliches Angebot zum Abschluss eines Kaufvertrags ab. Der Vertrag kommt mit der Bestätigung per E-Mail zustande.

4. PREISE & VERSANDKOSTEN

Alle angegebenen Preise enthalten die gesetzliche Mehrwertsteuer (sofern erforderlich). Versandkosten werden im Bestellvorgang gesondert ausgewiesen. Bei internationalen Bestellungen können zusätzlich Zölle oder Steuern anfallen, die vom Käufer zu tragen sind.

5. ZAHLUNG

Die Zahlung erfolgt vollständig im Voraus über die Website. Akzeptierte Zahlungsmethoden sind PayPal und Stripe.

Für Workshops gilt: Ein Platz ist nur dann reserviert, wenn die vollständige Zahlung eingegangen ist.

6. VERSAND

Prints werden weltweit mit zuverlässigen Versanddienstleistern (z. B. DHL) verschickt. Die Lieferzeit beträgt in der Regel 7–14 Werktage ab Zahlungseingang. Bei Bestellungen außerhalb der EU bitte vorab Kontakt aufnehmen, um die Versandkosten zu klären. Wenn ein Print beschädigt ankommt, muss der Schaden innerhalb von 5 Tagen nach Zustellung mit aussagekräftigen Fotos per E-Mail gemeldet werden, um einen Ersatz zu erhalten.

7. WORKSHOPS

Die folgenden Bedingungen gelten für alle Workshops (1:1, 2:1, Gruppenworkshops und Online-Workshops):
  • Workshops finden unabhängig vom Wetter statt. Bitte kleide dich entsprechend und sei vorbereitet.
  • Die volle Zahlung ist bei Buchung fällig, um einen Platz zu sichern.
  • Stornierungen bis 30 Tage vor dem Workshop sind möglich und werden voll erstattet (innerhalb von 14 Tagen).
  • Bei einer Stornierung innerhalb von 30 Tagen vor dem Workshop oder bei Nichterscheinen erfolgt keine Rückerstattung, ohne Ausnahme. Die Teilnahme kann jedoch auf eine andere Person übertragen werden.
  • Falls Marco Wilm den Workshop absagen muss (z. B. Krankheit, unvorhergesehene Ereignisse oder höhere Gewalt wie Naturkatastrophen, Krieg, Pandemien, behördliche Anordnungen), wird entweder der volle Betrag zurückerstattet oder ein Ersatztermin angeboten. Reise- oder Übernachtungskosten werden nicht erstattet.
  • Die Teilnahme erfolgt auf eigene Gefahr. Marco Wilm übernimmt keine Haftung für Unfälle, Verletzungen oder Schäden.
  • Reise-, Unterkunfts- und Verpflegungskosten sind nicht im Workshoppreis enthalten, sofern nicht ausdrücklich angegeben.
  • Bei Verspätung bitte unverzüglich Marco kontaktieren. Bei Gruppenworkshops wird maximal 10 Minuten gewartet, danach beginnt der Workshop. Die Teilnahme ist weiterhin möglich – der Standort wird zur Orientierung geteilt.
  • Bei unangemessenem Verhalten, das die Sicherheit oder das Wohlbefinden anderer gefährdet, behält sich Marco das Recht vor, die betreffende Person ohne Rückerstattung vom Workshop auszuschließen.

8. URHEBERRECHT & VERTRAULICHKEIT

Alle im Workshop geteilten Inhalte (Bilder, Bearbeitungstechniken, Präsentationen, E-Books, Handouts usw.) sind vertraulich und unterliegen dem Urheberrecht von Marco Wilm.
Die Aufzeichnung, Weitergabe oder kommerzielle Nutzung dieser Inhalte ist nur mit ausdrücklicher Genehmigung gestattet.

9. FOTO- UND VIDEOAUFNAHMEN

Marco Wilm kann während des Workshops Fotos oder kurze Videos (z. B. „Behind-the-Scenes“-Material) zur späteren Veröffentlichung auf der Website oder in sozialen Medien aufnehmen.

Wenn du nicht auf diesen Aufnahmen erscheinen möchtest, teile das bitte vor Beginn des Workshops mit – dein Wunsch wird selbstverständlich respektiert.

10. RÜCKGABE & BESCHÄDIGTE PRODUKTE

Alle Fine-Art-Prints werden individuell und mit großer Sorgfalt gefertigt. Rückgaben, Stornierungen oder Umtausch sind ausgeschlossen, sobald eine Bestellung abgeschlossen ist.

Sollte ein Print dennoch beschädigt ankommen, sende bitte innerhalb von 5 Tagen nach Erhalt eine E-Mail an info@marcowilmphotography.com, inklusive Bestellnummer, Beschreibung des Schadens und Fotos des beschädigten Produkts sowie der Verpackung.

Bei bestätigtem Transportschaden erhältst du kostenfrei einen Ersatz.

Leichte Farbabweichungen, die durch unterschiedliche Bildschirmdarstellungen entstehen, gelten nicht als Mangel.

11. ONLINE-STREITBEILEGUNG

Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (ODR) bereit, die du unter folgendem Link erreichst:

12. ANWENDBARES RECHT & GERICHTSSTAND

Es gilt das Recht der Bundesrepublik Deutschland.
